As the terms and conditions may be updated from time to time (for example to reflect changes in technology, our business model, our system’s capabilities or relevant laws and regulatory requirements), we recommend that you check this page regularly to take notice of any changes we may have made in the terms and conditions.

These terms cover the website and related services. We ship from Denmark. Delivery services are provided by UPS and PostNord.

We only ship to those countries listed in the delivery policy

Use of website

The website and related services (“services”) are made available to you in accordance with the following terms of use, and any other rules posted on our websites (“terms”). Please read the terms carefully before placing any orders, we recommend that you keep a copy of the terms for future reference.

In particular, we wish to draw your attention to our policies relating to the purchase of products, and our privacy policy. If you are under 13 years of age you must let your parent or guardian know about our privacy policy before you register to use our services. We reserve the right to only accept orders from those over 18 years of age.

We may modify the terms from time to time at our sole discretion. Please read the terms and check back often. If you do not agree to any change to the terms then you must immediately stop using the services. Please note that these terms do not affect your statutory rights as a consumer. For more information about your rights contact your local citizens advice bureau or trading standards bureau.

The services may include links to other websites or resources. We have no control over the content of these websites and are not liable in any way for their content.

We have the right to remove any material or posting you make on the website at our sole discretion.

Registration

You will need to register in order to use some of the services or features available to you on this website. You agree that the information that you provide when you register is true, accurate, current, and complete in all respects. Should any of your registration information change, please notify us immediately at hello@artemiscph.com. We may also change registration requirements from time to time. We may change, withdraw, or suspend access to the services (in whole or in part and permanently or temporarily) with or without notice and with no liability to you.

The account password you provide should be unique and kept secure, and you must notify www.artemiscph.com immediately of any breach of security or unauthorised use of your account.

Purchasing of products

In order to make purchases on the website, you will be required to provide your personal details. In particular, you must provide your real name, phone number, e-mail address and other requested information as indicated. Furthermore, you will be required to provide payment details that you represent and warrant are both valid and correct and you confirm that you are the person referred to in the billing information provided.

The website is available only to individuals and others who meet the www.artemiscph.com terms of eligibility, who have been issued a valid credit/debit card by a bank acceptable to www.artemiscph.com, whose applications are acceptable to www.artemiscph.com and who have authorized www.artemiscph.com to process a charge or charges on their credit/debit card in the amount of the total purchase price for the merchandise which they purchase.

By making an offer to purchase merchandise, you expressly authorize us to perform credit checks and where www.artemiscph.com feels necessary, to transmit or to obtain information (including any updated information) about you to or from third parties, including but not limited to your credit/debit card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction), to authenticate your identity, to validate your credit/debit card, to obtain an initial credit/debit card authorization and to authorize individual purchase transactions.

Furthermore, you agree that we may use personal information provided by you in order to conduct appropriate anti-fraud checks. Personal information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

Online orders

You agree that your order is an offer to purchase the product(s) listed in your order to us on the terms. All orders are subject to our acceptance and availability. Items that are placed in your shopping basket are not reserved and may be purchased by other customers. We will inform you if we are unable to fulfil your order. We may choose not to accept your order at our discretion for any reason without liability to you. Examples of occasions in which we may not accept your order include: we are unable to obtain authorisation for payment; shipping restrictions apply to a particular item; the item ordered is out of stock; the item ordered does not satisfy our quality control standards and is withdrawn; or you do not meet the eligibility criteria set out within the terms.

Please note that we may refuse to process an order that is a multiple of a single product, for example an order for three of the same dress.

The purchasing or acquiring of goods from us is for your own personal and private use and it is expressly forbidden to use the goods purchased or acquired for any commercial or business purpose including, but not limited to, in any film, television programme or advertisement without express permission from ARTEMIS.

We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the website whether or not that merchandise has been sold, removing, screening or editing any materials or content on the services, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

After submitting an order to us, we will send you an order acknowledgment email. This email will include your order number, details of the products you have ordered from us and delivery details. Please note that this email is an acknowledgement of your order and is not an acceptance of your order. Acceptance of your order and formation of a contract of sale takes place when your order has been dispatched and we have sent you an email confirming this.

You will be charged for products on our acceptance of the order as ready for dispatch. If we are unable to fulfil your order for any reason, you will not be charged.

Returns & exchanges

We hope that you are delighted with every order you receive from www.artemiscph.com, but if you are not perfectly satisfied with your items please find all information regarding returns here. 

Return policy for web orders

Please take care trying on items as all products must be returned in a new and unused condition with all ARTEMIS tags and labels still attached. Returns that are damaged or soiled will not be accepted and will be sent back to the customer and/or a refund or exchange refused.

We offer a flexible returns policy to make your online shopping experience even easier. We do monitor the number of returns made by customers, and continued returns will be flagged and potentially refused at our discretion or lead to the closure of your artemiscph.com account.

Please remember that parcels that are returned to us remain the customer’s responsibility until  the parcel reaches us.

Made-to-order dresses

Made-to-order dresses are not available for online shopping and the dresses are measured and all details/alterations are noted at the customers fitting appointment at the Copenhagen shop.
When the order has been made with our atelier we have a delivery time of 4-6 weeks for the dress to be made and delivered to the shop for the customer to pick up.

Made-to-order dresses cannot be returned or exchanged because they are made for a specific person.
If you want to purchase a dress in our standard size range (34-44) and have it altered at your own expense, please contact us at hello@artemiscph.com and we will be glad to help.

Prices

Garment prices shown on the website are in DKK, or EURO and are inclusive of value-added tax. Garment prices do not include delivery costs. The DKK or EURO price of a product displayed on the website at the time the order is accepted will be honoured, except in cases of obvious error.

Product prices are set at the beginning of each season using existing currency exchange rates. These prices are subject to change if the applicable currency exchange rate changes before your order is accepted or the items are subject to markdowns at any time during the selling period.

If you are a customer whose credit/debit card is not denominated in DKK or EUR, the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction. Your card issuer or payment method provider may therefore apply other international bank charges. We have no control and cannot predict the amount of these charges. Please contact your issuing bank before placing your order if this applies to you.

Faulty or damaged goods

Goods are faulty if they are received damaged. Items that are damaged as a result of normal wear and tear are not considered to be faulty. Where possible, we will offer to repair faulty items. If repair is not possible or the same product is not available, you are entitled to a full refund. This does not affect your right to cancel the contract under the regulations.

Copyright & Trademarks

All contents included on the Website, such as, but not limited to, design, text, graphics, logos, video and audio clips, images, button icons and the compilation thereof, software compilations, source coding and software, are the property of ARTEMIS or our suppliers. The contents are protected by Danish and international copyright laws. ARTEMIS or our content suppliers own the copyright to the above mentioned. The contents of the Website may only be copied for your own private use. Any other use of the information and material on the Website, such as reproduction, modification, distribution, transmission, republication, display or performance is strictly prohibited. You may there-fore not – besides your own private use – copy, display, download, distribute, alter, modify, reproduce, re-publish or rephrase information, text, documents or other material from the Website or any other part of the Website without the explicit consent from ARTEMIS or our suppliers. Brand names, product names, logos and titles that appear on the Website are trademarks or trade names and are property of ARTEMIS or our suppliers. Any reproduction of such trademarks or trade names constitutes an infringement of the owner’s rights and is strictly prohibited, unless it is for your own private use.

Disclaimer of Liability 

We are only liable for damages when such damages result from our breach of contractual obligations towards you, or in the event our liability follows from applicable statutory law. 

If any activities on artemiscph.com have caused you damage, we shall only be liable for damage to the ARTEMIS products, reasonable and verifiable costs incurred by you to find out the cause and amount of damages as a result of our breach of contract or liability under applicable statutory law; and reasonable and verifiable cost to prevent and diminish such damages. 

We shall not be liable for any damages incurred by a third party resulting from use of our products. Neither shall we be liable for your improper use of any of our products. To the fullest extent permitted by law, we shall not be liable for any damages resulting from incorrect information on the Website. 

The limitations mentioned above shall not apply in the event you suffer damages resulting from our gross negligence or wilful misconduct.

We guard and respect our customers’ personal data and safety, although we cannot totally guarantee the security of information and payments transmitted online. To the fullest extent permitted by law, we shall not be liable for damages suffered as a result of the use of electronic means of interactions, such as, but not limited to, damages resulting from errors or delays in delivery of communication, interception or manipulation by third parties or by computer programs and transmission of viruses.

Information on the Website

We make a great effort to avoid errors on the Website, but information, text, images, graphics, video and audio clips and other website services may temporarily contain errors, be incomplete or incorrect. In such events – to the fullest extent permitted by law – we cannot be held liable for damages resulting hereof, unless such damage is the result of our gross negligence or wilful misconduct.

We shall not be liable for any use of or any content of internet sites that this Website provides links to. Neither shall we be liable for use or content of any websites from which are linked to this Website.

Applicable Law

Without limiting your rights as a consumer under the laws of your country, these terms and conditions as well as all disputes or claims arising hereof and of using or shopping on the Website shall be governed by the laws of Denmark.

Our right to vary these terms and conditions

We reserve the right to revise and amend these terms and conditions from time to time. Your order will be subject to the policies and terms and conditions in force at the time when you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or govern-mental authority (in which case it will apply to orders previously placed by you). If we change these policies or these terms and conditions after you have placed your offer, but before we send you the order confirmation, we will notify you of this. If you do not inform us that you can accept these new policies or these terms and conditions within seven working days, we will cancel your offer and notify you by e-mail.

Our relationship

You acknowledge and agree that no joint venture, partnership, employment, or agency relationship exists between you and ARTEMIS as a result of the terms or your use of the services. You agree that you may not and will not hold yourself out as a representative, agent, or employee of ARTEMIS, and we shall not be liable for any representation, act, or omission on your part.

By placing an order you agree and understand that we may store and process your personal data in accordance with our privacy policy.
